Terms and Conditions


Access to and use of AROMATERRA.EU and the products and services available through this Website are subject to the following Agreement, its Terms and Conditions as well as notices (referred to as “Terms of Purchase” or “Terms and Conditions” herein).

General Conditions

1.1. The Customer confirms and accepts these Terms and Conditions of AROMATERRA.EU by ticking “I’ve read the Terms and Conditions” and clicking the “Place Order” button. When accepted, these “Terms and Conditions” become a legal document obligatory for the Parties, which establishes the rights and commitments of the Customer and Seller, the conditions of purchase of and payment for goods, the procedure of delivery and return / exchange of goods, responsibility of parties as well as other conditions related to sale and purchase on the online shop AROMATERRA.EU.

1.2. We reserve the right to revise and amend these Terms of Service from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities or for any other reason in our sole discretion which we may decide. By using the Services, you are agreeing to all of the Terms of Service. Any updates and modifications to the Terms of Service will be announced to you upon the time of registration. In order to complete your order with us, you will have to comply with our Terms of Service.

1.3. Online shop AROMATERRA.EU expands beyond the borders of Lithuania and trades in the rest of European Union countries.

1.4. The following Buyers can shop in the online shop AROMATERRA.EU: natural persons with full rights as citizens; underage persons (14-18 years old) having the consent of parents or carers to shop with us, with the exception to the case when you are in self-possession of your income; legal persons; legal representatives of the aforementioned person(s).

1.5. By accepting the Terms and Conditions of our Service, the Buyer confirms he/she holds the right to place an order with AROMATERRA.EU in accordance with clause 1.4. of the Terms and Conditions herein.

2. Personal Data Protection and Privacy Policy

2.1 The Customer may order products from the online store AROMATERRA.EU by following these steps:

2.1.1. By registering on this online shop, i.e. using their username and password.

2.1.2. By not registering on this online shop.

2.2. In order to commission goods in the ways outlined under the section 2.1.1. , The Customer has to provide the Website with the information needed for proper execution of the order by entering in the Website’s information fields the following personal data: name, surname, delivery address, telephone number and e-mail address.

2.3. The Customer agrees to these Terms and Conditions allowing his or her personal data referred to in section 2.2. to be processed for Seller performance planning and analysis of the online shop AROMATERRA.EU, and agrees for his/her personal data, i.e. name, surname, delivery address, telephone number and e-mail address to be revealed to the Seller’s affiliate partners, who provide shipping / delivery to the Customer or any other appropriate order fulfilment services.

2.4. By agreeing that his/her personal data be processed for the purposes of sale of goods and services by the Seller’s online store, the Customer also agrees for notifications to be sent to the specified e-mail address and telephone number as needed for proper order fulfilment.

2.5. The Seller confirms that the Customer’s personal data will be processed solely for sale purposes by the goods and services online shop AROMATERRA.EU, Vendor performance planning and analysis. The Supplier undertakes not to disclose the Customer’s personal data to third parties other than the Supplier’s partners, who provide delivery or other proper order fulfilment services. In all other cases, the Customer’s personal data may be disclosed to third parties only in accordance with the procedures laid down in the legislation of the Republic of Lithuania.

2.6. If the Customer does not agree to the Privacy Policy summarised in this section of the Terms of Service, the Customer loses the right to use the services of the online shop AROMATERRA.EU.

3. The Customer -Supplier Agreement

3.1. The Agreement is enforced from the very moment the Customer chooses to check out and clicks on the link to pay for the order.

3.2. Every single Agreement ever made between the Customer and the Seller is registered and stored in AROMATERRA.EU data base.

3.3. AROMATERRA.EU does not commit themselves to notify additionally the Customer on their consent to enter into the Agreement. AROMATERRA.EU confirms the order from the moment when the order is started to be processed.

4. Customer Rights

4.1. The Customer has the right to shop online in AROMATERRA.EU in compliance with its Terms and Conditions as well as information provided in other sections of this online shop by the Seller.

4.2. The Customer has the right to cancel or return his/her order and terminate the contract with AROMATERRA.EU online shop by notifying the Seller in writing within 14 (fourteen) working days of receiving the order (via e-mail, indicating the product(s) the Customer is willing to return and its order number), except for the cases, where subject of contract is one of the following:

4.2.1. supply of cosmetics, perfumery, home cleaning supplies and hygiene goods;

4.2.2. supply of books, newspapers, journals and other periodicals;

4.2.3. goods manufactured in accordance with personal needs of the Customer or according to conditions presented by the Customer;

4.2.4. food commodities, if the Customer was supplied with a product of proper quality with a valid expiry term;

4.2.5. commodities which cannot be returned in accordance with their properties, including products perishable goods and expired products;

4.2.6. in other cases, when refusal of Purchase – Sale Agreement is impossible in accordance with legal laws.

4.3. The Customer is subject to the Website’s return policy as set out in clause 4.2 only if the item(s) the Customer is willing to return retains its original form, has not been used, damaged nor violated in any other way. Also, it must be in its original package and in the same condition as received.


5. Customer Commitments

5.1. You must pay for your order and collect it in compliance to the aforementioned Terms and Conditions.

5.2. Upon your registration, you agree to undertake the sole responsibility of your login information and commit to refrain from sharing it with the third parties. In case of data loss, you must inform us immediately by means provided in the Contact section.

5.3. You must keep your personal and contact information up to date at all times. If your information changes, you commit to update it immediately.

5.4. By signing up with AROMATERRA.EU, you undertake to follow the Terms and Conditions clearly set out by this online shop and to comply with the legislation of the Republic of Lithuania.

6. Seller Rights

6.1. The Seller reserves the right to immediately and without warning suspend or limit the Customer‘s account and Service availability if the Customer in any way offends the Terms of Services as imposed by the Supplier.

6.2. Under special circumstances, the Seller reserves the right to suspend the online shop‘s activity either temporarily or altogether without any prior notice to the Customer.

6.3. The Seller holds the right to terminate the order without any prior notice to the Customer provided the Customer chose the payment method mentioned in clauses 8.2.1. or 8.2.2. and failed to pay for the item(s) within 3 (three) working days.

7. Seller Commitments

7.1. The Seller commits to provide the Customer with the ability to use the Services of online shop AROMATERRA.EU in compliance to the Terms of Conditions of the Supplier.

7.2. The Seller agrees to respect the Customer‘s right to his/her private information as it is stated in the Terms of Service section number 2 and the Legislation of Lithuanian Republic.

7.3. The Seller commits to deliver The Customer‘s order to his or hers provided address.

7.4. Under special circumstances when the Seller fails to deliver the exact order to the Customer, the former agrees to offer the alternative product or service to the Customer. If the Customer refuses to accept the alternative, the Supplier commits to refund the Customer fully within 3 (three) working days, provided the Customer paid for the goods in advance.

7.5. The Seller commits to fully refund the Customer within 10 (ten) working days starting with the receiving day of the order, provided the Customer is returning the order in accordance to clause number 4.2 of the Services.

8. Product Costs and Payments

8.1. Prices advertised on the Website are in EUR. Delivery costs may be charged additionally; such additional charges are clearly displayed where applicable and included in the “Total Cost”.

8.2. You can pay for your order by choosing one of these payment methods:

8.2.1. Payment by electronic banking: pre-pay using electronic banking system. You can transfer your payment to AROMATERRA.EU bank account via internet by choosing the bank of your choice from the selections menu. The bank holds sole responsibility for the protection of your data as all transactions are made through the online banking system.

8.2.2. Payment by bank transfer: pre-pay using the printed order form. You can pay for your order by visiting your nearest bank branch and placing a payment directly to AROMATERRA.EU back account.

8.3. By using the payment methods mentioned in the 8.2.1. and 8.2.2 clauses, the Customer commits to make a payment immediately.

8.4. By accepting the terms of Services, the Customer agrees to receive the VAT invoice of the order via e-mail address provided by the Customer in the registration application. The invoice also serves as a warranty card.

8.5. Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. The cost of products and services may fluctuate accordingly to such factors as technological errors in the system or additional costs concerning the product or service (LR Civil Code, paragraph 6.313, line 7). All prices advertised are subject to such changes. If you refuse to pay for your newly-charged order, both of the parties involved are applicable to cancel the order. All charges involved in the determination of the order are not refundable.

9. Delivery, Shipping and Risks Related

9.3. The Order can only be claimed by the Customer. You must prove your identity to the post office worker before claiming the order (an identification card, a passport or new edition driver‘s license).

9.4. The ownership of the goods purchased from AROMATERRA.EU shop as well as the risk of damage of goods while shipping them goes to buyers upon receipt of goods. Having chosen shipping via registered post service, buyers commit themselves to collect the goods from their post service within the term indicated in the post notice. The risk of accidental damage of goods goes to buyers when the term indicated in the post notice ends.

10. Warranty and Quality Control

10.1. The Supplier is not held responsible for any discrepancies in the products’ actual form, size, or colour as these may vary due to the Customers computer (device) Display settings.

11. Refunds and Exchange

11.1. Defects of sold goods will be eliminated, faulty goods exchanged and returns accepted in accordance with the Minister’s of Economy approved Rules for the return and exchange of goods Order No. 217 (29 June 2001): “About the Approval of the return and exchange of goods rules”.

11.2. In order to return the item(s) following the order of circumstances referred to in clause number 11.1, the Customer must fill out the return of goods document form that is attached to their order, and submit it along with the returned item(s).

11.3. The Customer reserves the right to take advantage of the clause number 11.1. which allows him to inform the Supplier by adhering to the Terms of Service outlined in clause number 4.2. within 14 (fourteen) working days from the date of delivery of the goods.

11.4. When returning the goods, the Customer is subject to the following conditions:

11.4.1. returned item(s) must be in the original orderly packaging (this does not apply to the return of faulty goods);

11.4.2. the item(s) must be intact;

11.4.3. the product must be unused, and have retained its marketable appearance: its labels and security pellicles must be intact, etc. (this does not apply to the return of faulty goods);

11.4.4. returned item must be in the same configuration as it was received by the Customer;

11.5. The Supplier reserves the right not to accept the Customer’s returned goods if the Customer fails to comply with the procedure for the returning of the goods as laid down by this Agreement.

11.6. If the Customer refuses the sale of purchase, he or she is entitled to cover all the delivery / dispatch costs for the goods returned to the Supplier. The total amount paid for the goods is fully refunded, excluding the aforementioned delivery costs. The amount for the goods returned is transferred via bank transfer exclusively to the Payer’ bank account.

12. Responsibilities and Liability

12.1. The Customer takes full responsibility for providing the Supplier with accurate personal information. If the Customer fails to do so, the Supplier will not be held responsible for the consequences of misrepresentation and is consequently entitled to the compensation from the Customer due to the sales loss.

12.2. The Customer is responsible for his or her own actions when using this Website.

12.3. Upon registration, the Customer is responsible for the protection of his own personal data against third parties. If any third party uses the Services of the Website through the Customer‘s account, they will be automatically regarded as the Customer by the Supplier.

12.4. The Supplier is free from any sort of responsibility or liability in cases of loss due to the very fault of the Customer, i.e. if the Customer did not familiarize himself/herself with the Terms of Service of the Website and disregarded the recommendations and the terms of the Supplier even when provided with such opportunity.

12.5. Our Website may contain links to and from the websites of our partner networks, advertisers and other third parties. If you follow a link to any of these websites, please note that they have their own privacy policies and that we do not accept any responsibility or liability for these policies.

13. Governing Law and Jurisdiction

13.1. These Terms and Conditions are to be construed in accordance with the laws of the Republic of Lithuania and irrespective of your place of domicile.

13.2. In the event of any dispute associated with these Terms and Conditions, that dispute shall be subject to the exclusive jurisdiction of the Lithuanian Courts.

13.3. If the Customer has compaints to the online shop AROMATERRA.EU, they shall be sent be e-mail to the address info@aromaterra.eu.
